BELA REGULATIONS: Stop the Power Grab and Protect School Autonomy and Fair Access

The Department of Basic Education has proposed BELA-regulations that threaten the democratic governance of public schools and risk undermining parents’ and communities’ roles in shaping education. Key provisions in these draft regulations hand sweeping powers to the Head of Department (HoD), allowing them to override School Governing Bodies (SGBs) and reshape feeder zones and language policies without adequate transparency or accountability.

Key concerns:

  • Clause 6.1 – Undermines SGB authority by allowing the HoD to unilaterally override decisions under vague terms like “practicability,” opening the door to arbitrary interference in school governance.

“6.(1) The HOD has final authority to admit a learner to a public school, after consultation with the governing body of the school but such authority does not override any appeal decision taken by the Member of the Executive Council in terms of section 5(9) of the Act.”

  • Clause 21 – Grants the HoD broad power to determine and amend feeder zones, with Clause 21.3 permitting changes based on “population projections,” a vague criterion that could be used ideologically to manipulate school demographics.

  • Ambiguity and Overreach – The regulations rely heavily on interpretations of clauses like 5.9 and 5.11 to control 5.7, which itself empowers the HoD to impose additional language instructions on schools, potentially eroding mother-tongue education and local policy-making, as well as undermining the SGB.
