Stop the Public GAG Order: Say NO to the Polling Ombud

South Africa’s democracy thrives on informed citizens and open debate. But a new proposal threatens to silence vital sources of public information. The Draft Electoral Laws Amendment Bill currently open for public input seeks to create a Polling Ombud—a new body with sweeping powers to control, restrict, and punish the publication of political opinion polls and exit polls and the regulation of who may do polling in the first place.

This bill is not about transparency. It’s about control. It gives government-appointed officials the power to decide who can conduct polls, when results can be released, and what information can be shared with the public.

Key concerns with the bill

  • Censorship of Information: Individuals or organisations will need prior approval from the Ombud to publish poll results—even if they’re independent and credible.

  • Registration Requirements: Anyone conducting a political or exit poll must register and submit detailed information to the Ombud for vetting.

  • Pre-Election Blackout: The publication of political opinion polls is banned for seven days before any election, depriving the public of timely, relevant information.

  • Criminalisation of Polling: Failing to comply with these provisions could lead to fines or up to two years in prison.

  • Centralised Control: The Ombud is not independent—it’s appointed under the authority of the Electoral Commission and Chief Electoral Officer.
