Key concerns with the Equitable Access to Land Bill

1. Race-Based Land Redistribution
  • The Bill explicitly seeks to restructure land ownership based on racial demographics rather than economic need, agricultural expertise, or legal property rights.
  • This violates constitutional principles of equality and sets a dangerous precedent for race-based expropriation.

2. Expropriation Without Compensation
  • The Expropriation Act (2025), recently signed into law, allows for land seizures with zero compensation if deemed in the “public interest.”
  • The new Bill defines “public interest” primarily in racial terms, meaning property will be confiscated not based on fair market principles, but on racial quotas.

3. Economic Collapse & Loss of Foreign Investment
  • International investors are already pulling out due to concerns over property rights. South Africa risks becoming another Zimbabwe, where land seizures led to economic collapse.
  • This will severely damage international relations, especially with key partners like the U.S. and EU. Trade agreements could be at risk.

4. Threat to Food Security
  • Many productive farms will be transferred to new owners without farming experience, leading to lower agricultural output, rising food prices, and increased food insecurity.
  • The government has a track record of failed land reform projects, where previously expropriated land became unproductive.

5. Legal Uncertainty & Constitutional Violations
  • The Bill contradicts the property rights enshrined in Section 25 of the Constitution.
  • It creates legal chaos for landowners, with no clear framework on how expropriation decisions will be made.
